Employee Leave Rights Under Turkish Labor Legislation

In Turkey, labor legislation establishes a structured framework that allows employees to take time off for significant life events while ensuring continuity in employment relationships. The Turkish Labor Law defines several types of statutory leave, including maternity, paternity, marriage, bereavement, and job-search leave, all of which support a healthy balance between professional duties and personal responsibilities.

Maternity Rights and Leave Provisions

Female employees in Turkey benefit from extensive maternity protections. The standard maternity leave period is 16 weeks, divided evenly between eight weeks before and eight weeks after childbirth. In cases of multiple births, such as twins or triplets, the total leave period is extended to 18 weeks.

Expectant mothers may choose to continue working until three weeks prior to delivery, provided a medical certificate confirms that doing so does not pose a health risk. Any unused pre-birth leave is then transferred to the postnatal period.

Following the completion of paid maternity leave, employees may request up to six months of unpaid leave. This additional period does not affect the employee’s annual leave entitlement. During pregnancy, employees are also entitled to paid time off for medical check-ups. After returning to work, mothers may request daily breastfeeding breaks totaling 1.5 hours until the child reaches one year of age.

Eligibility for maternity leave and related benefits requires a medical report indicating the expected delivery date. This documentation is also used for maternity benefit payments through the relevant social security institution.

Paternity Leave Entitlement

Male employees are entitled to three days of paid paternity leave following the birth of their child. This short leave period acknowledges the father’s role during the early stages of family life and supports parental involvement.

Leave for Marriage

Turkish labor law grants employees three days of paid leave upon marriage. This entitlement allows employees to celebrate and organize their personal affairs during an important life event without financial concern.

Bereavement Leave

In the event of a family loss, employees are entitled to three days of paid bereavement leave. This right applies to the death of close relatives, including parents, spouses, siblings, and children, offering employees time to grieve and manage family responsibilities.

Job Search Leave During Notice Period

Employees who are serving a notice period are legally entitled to time off to seek new employment. Turkish Labor Law provides a minimum of two hours per working day for job searching. These hours may be accumulated and taken together if agreed.

If an employee is required to work during their job-search leave, the employer must compensate the employee at double the regular hourly wage for that time.
